Bored2AI Terms of Service

1. Welcome

Welcome to Bored2AI ("Bored2AI", "we", "our", or "us").

By creating an account or using our website and services, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use Bored2AI.

You must comply with all applicable laws and regulations in the jurisdiction where you access or use Bored2AI.

We may update these Terms from time to time. If we make significant changes, we will notify users through our website or email, where appropriate. Continued use of Bored2AI after the revised Terms become effective means you accept the updated Terms, subject to applicable law.

2. Our Services

Bored2AI provides AI-powered tools and services, which may include text generation, image generation, video generation, automation tools, APIs, community features, remix functionality, and other AI features.

Some services are powered by third-party AI providers. Features, pricing, and availability may change from time to time.

Certain features, content types, or services may be restricted or unavailable in particular countries or jurisdictions where their use is prohibited or subject to additional legal or regulatory requirements.

3. Your Account

You are responsible for:

• Providing accurate registration information.
• Keeping your password and account secure.
• All activity that happens under your account.
• Ensuring that your use of Bored2AI complies with all applicable laws and regulations in your jurisdiction.

Please contact us immediately if you believe your account has been compromised.

We may suspend or terminate accounts that violate these Terms or are used fraudulently.

You may choose to subscribe to Bored2AI newsletters and promotional communications separately from creating an account. Newsletter subscription is voluntary and is not required to register for or use Bored2AI, except where a specific optional promotion is expressly offered on disclosed terms and permitted by applicable law.

4. Acceptable Use

You agree not to use Bored2AI to:

• Break any laws or regulations applicable to you or your use of the service.
• Generate, upload, share, distribute, or facilitate illegal, harmful, abusive, or fraudulent content.
• Generate, upload, distribute, or facilitate child sexual abuse material (CSAM), or any content depicting or sexualising minors in suggestive, sexual, violent, or otherwise inappropriate contexts, including fictional, animated, anime, manga, or similar representations such as Loli or Shota content.
• Generate, upload, share, remix, or distribute sexually explicit, intimate, compromising, or otherwise abusive content depicting a real individual without that individual's explicit consent, including non-consensual intimate imagery (NCII) and non-consensual deepfakes.
• Use another person's photograph, image, likeness, identity, or other personal material to create or remix content in a manner that violates their consent, privacy, publicity, intellectual property, or other legal rights.
• Generate content that promotes, glorifies, or encourages extreme graphic violence, self-harm, or suicide.
• Generate, promote, support, or facilitate content that supports terrorist organisations or violent extremist activities.
• Generate or distribute content that promotes violence, incites hatred, or discriminates against protected groups based on race, religion, gender, nationality, or other legally protected characteristics.
• Infringe someone else's intellectual property, privacy, publicity, or other legal rights, including through the use of Community Content or the remix functionality.
• Attempt to hack, reverse engineer, or disrupt our platform.
• Bypass security measures or abuse our systems.
• Use our services for spam, scams, phishing, malware, or other fraudulent or abusive activities.

Zero-Tolerance Policy

Bored2AI applies a zero-tolerance policy to serious violations involving child safety, non-consensual intimate imagery, violent extremism, severe graphic violence, self-harm promotion, and hate-based violence or discrimination.

Any account found to have engaged in such prohibited activities may be suspended or permanently terminated without prior notice, subject to applicable law and any rights that may apply to the user.

Where Bored2AI becomes aware of suspected CSAM or other child sexual exploitation, we may preserve relevant information and report the matter to appropriate authorities, including the National Center for Missing & Exploited Children ("NCMEC") where required or appropriate under applicable law. U.S.-based electronic service providers may have specific reporting obligations to NCMEC's CyberTipline.

We reserve the right to suspend, permanently remove, or restrict accounts or content that violate these rules.

5. MENA Region Specific Requirements

To support compliance with applicable laws and regulatory requirements in countries across the Middle East and North Africa ("MENA"), additional restrictions may apply to users accessing or using Bored2AI from MENA jurisdictions.

Religious and Cultural Sensitivities

Users must not use Bored2AI to generate, publish, distribute, remix, or facilitate content that unlawfully or intentionally:

• Disrespects, mocks, insults, or defames religious figures or persons revered by a religion.
• Mocks, desecrates, or otherwise unlawfully denigrates holy books, religious texts, or sacred symbols.
• Promotes or facilitates content that is prohibited under applicable laws relating to religious beliefs, sacred practices, or religious harmony.
• Incites religious hatred, hostility, or violence.

Users are responsible for complying with the laws and regulations applicable in the country from which they access or use Bored2AI.

National Security and Political Figures

Users must not use Bored2AI to generate, publish, distribute, remix, or facilitate:

• Deepfakes or materially deceptive representations of national leaders, government officials, or other public figures where such content is prohibited by applicable law.
• Content that falsely represents a national leader, government official, or public figure as having made statements or engaged in conduct that they did not make or engage in, where such content is unlawful or intended to mislead.
• Content that unlawfully insults, defames, threatens, or degrades national leaders, government officials, national symbols, or state institutions.
• Content intended to undermine national security, incite violence, civil unrest, terrorism, or other unlawful activities.
• Content that violates applicable laws concerning national sovereignty, government institutions, public order, or national security.

Certain countries may impose additional restrictions on AI-generated depictions of public figures, national symbols, government institutions, or political content. Users are solely responsible for ensuring that their use of Bored2AI complies with the laws applicable in their jurisdiction.

Bored2AI may restrict, block, or remove content or functionality where we reasonably believe that continued provision or use may violate applicable law or expose Bored2AI, its users, or its service providers to legal or regulatory risk.

6. AI-Generated Content

AI-generated content may contain mistakes, inaccuracies, or biased information.

You are responsible for reviewing and verifying any content before relying on or publishing it.

Bored2AI does not guarantee the accuracy, legality, originality, ownership, or suitability of AI-generated content and is not responsible for decisions made based on that content.

You remain responsible for ensuring that AI-generated content complies with applicable laws, regulations, and third-party rights before publishing, distributing, remixing, or otherwise using it.

AI-generated content may resemble existing content or depict real individuals, whether intentionally or unintentionally. You are responsible for ensuring that your use of such content does not violate any applicable rights or legal requirements.

7. Payments

Some Bored2AI features require payment.

If you purchase credits or subscribe to a paid plan:

• Prices are displayed before purchase.
• Subscription plans renew automatically unless cancelled.
• You may cancel future renewals at any time.
• Used credits are generally non-refundable, subject to applicable law.
• Refunds for unused credits may be considered on a case-by-case basis, subject to applicable law.
• We may update pricing with reasonable notice, where appropriate.

Promotional offers, discounts, bonus credits, and other incentives may be subject to separate terms, including eligibility requirements, validity periods, usage restrictions, redemption conditions, and availability. The applicable offer terms will be made available when the promotion is presented.

Unless expressly stated in the applicable offer terms, a promotional offer does not guarantee any particular level of service, generation capacity, or continued availability of a feature.

8. Your Content

8.1 Ownership of Your Content

You retain ownership of the content you upload and, where permitted by law and our AI providers, the AI-generated content you create ("Your Content").

Nothing in these Terms transfers ownership of Your Content to Bored2AI, except for the limited rights expressly granted under these Terms.

Ownership of AI-generated content may depend on applicable law, the materials used to create it, and the terms of relevant third-party AI providers. Bored2AI does not guarantee that any particular AI-generated content is eligible for copyright protection or exclusive ownership.

You are responsible for ensuring that Your Content does not violate any laws or third-party rights, including intellectual property, privacy, publicity, and other applicable rights.

8.2 Permission to Process Your Content

You grant Bored2AI a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, transmit, display, and otherwise use Your Content to the extent reasonably necessary to operate, maintain, secure, and provide the services and features you use.

This includes processing Your Content through third-party service providers where necessary to provide the requested services, subject to applicable law and our Privacy Policy.

We do not use Your Content to train AI models unless you explicitly agree or such use is otherwise permitted by applicable law and disclosed in accordance with our applicable policies.

8.3 Community Sharing and Remix Permission

Bored2AI may provide a Community tab or other community features through which users can share AI-generated images, videos, prompts, or other content with other users.

Content that you choose to share publicly through the Community tab or a similar community feature is referred to as "Community Content".

By choosing to share Your Content as Community Content, you grant Bored2AI and other Bored2AI users a non-exclusive, worldwide, royalty-free licence to access, view, display, reproduce, and use that Community Content within Bored2AI for the purposes of providing, using, and participating in the platform's community and remix features.

This licence includes permission for other users to use Community Content as an input or reference for generating new AI-generated content through Bored2AI's remix functionality, where that functionality is available.

Where the relevant feature permits, this licence may include the use of associated prompts, generation settings, and other generation inputs that you have chosen or authorised to share with the Community. The scope of access to prompts and other inputs will depend on the relevant feature and the information disclosed to you when sharing the content.

A remix may materially alter, transform, or incorporate elements of the original Community Content. A user who creates a remix is responsible for ensuring that the remix and its subsequent use comply with these Terms and applicable law.

The licence granted under this section is limited to the purposes described above and does not authorise other users to exploit Community Content outside Bored2AI, except where separately authorised by the relevant rights holder or permitted by applicable law.

You understand that other users may create remixes that differ significantly from your original Community Content. Bored2AI does not guarantee that you will receive attribution, compensation, or approval rights in respect of any permitted remix unless expressly stated in a separate feature or agreement.

8.4 Rights and Permissions for Community Content

Before sharing Community Content, you must ensure that you own, control, or have obtained all rights, permissions, consents, and authorisations necessary to share that content and grant the licences described in these Terms.

If Your Content includes a photograph, image, video, likeness, voice, or other material relating to an identifiable person, you must ensure that sharing the content and permitting it to be remixed are lawful and consistent with any consent required from that person.

Where applicable law requires consent from a depicted individual or another rights holder, you must obtain that consent before sharing the content or permitting its use for remixing.

The fact that an image or video was generated or modified using AI does not remove the obligation to respect the rights of individuals depicted in, or otherwise identifiable from, that content.

Sharing content does not authorise any person to create non-consensual intimate imagery, sexualised deepfakes, harassment, impersonation, or other prohibited content. The Acceptable Use requirements in these Terms continue to apply to all Community Content and remixes.

Nothing in this section permits you to grant rights that you do not own or have authority to grant.

8.5 Visibility, Removal, and Existing Remixes

You may stop sharing Community Content or request its removal using the functionality made available by Bored2AI or by contacting us.

Once Community Content is removed from public access, Bored2AI will take reasonable steps to prevent further access to or use of that content through the relevant community features, subject to technical limitations, applicable law, and the legitimate operation of the services.

Removal of Community Content may not automatically remove remixes that other users have already created, or copies that have already been lawfully made available. Such remixes may remain available where permitted by these Terms and applicable law, unless removed by Bored2AI or required to be removed under applicable law or the relevant rights of affected persons.

Bored2AI may remove, restrict, or disable access to Community Content or remixes where reasonably necessary to enforce these Terms, address a complaint, protect users or third-party rights, or comply with applicable law.

You acknowledge that content shared publicly may be accessed, viewed, or used by other users in accordance with the permissions described in these Terms.

8.6 Private Content

Content that you have not chosen to share publicly through the Community tab or another public-sharing feature is not subject to the community remix licence in Section 8.3 merely because you generated or uploaded it to Bored2AI.

Private content may nevertheless be processed as necessary to provide the services you request, in accordance with these Terms and our Privacy Policy, or where otherwise required or permitted by applicable law.

8.7 Responsibility for Uploaded and Generated Content

You are responsible for ensuring that content you upload, generate, store, share, remix, or distribute through Bored2AI complies with the Acceptable Use requirements and any jurisdiction-specific requirements contained in these Terms.

Bored2AI does not endorse or guarantee the accuracy, legality, ownership, or suitability of Community Content or user-created remixes.

9. Third-Party Services

Bored2AI works with third-party providers, including AI model providers, payment processors, cloud infrastructure providers, and service providers supporting our communications and marketing activities.

Their services may have their own terms and privacy policies, and you may be required to comply with them when using those services through Bored2AI.

Where third-party providers process personal information on our behalf, their processing will be subject to applicable contractual safeguards and data protection requirements, as appropriate.

We are not responsible for outages or issues caused by third-party providers, subject to applicable law.

10. Privacy

Your privacy matters to us.

Our collection, use, disclosure, storage, and other processing of personal information are described in our Privacy Policy, which explains the purposes and legal bases for processing, applicable data retention practices, relevant third-party recipients, and the rights available to users under applicable law.

If our services require facial images or videos for AI generation, we will process that information for the purposes disclosed to you and in accordance with our Privacy Policy and applicable law.

Where you choose to share content through the Community tab, that content may become visible to other users and may be used for remixing as described in Section 8. You should not share content containing personal information, images, or other material that you do not wish to make available to other users in accordance with these Terms.

Where required by applicable law, we may retain, disclose, preserve, or provide information relating to prohibited activity to competent authorities, law enforcement agencies, regulators, or other legally authorised parties.

10A. Newsletter and Marketing Communications

Newsletter Subscription

Bored2AI may offer users the option to receive newsletters and promotional communications about our services, products, features, updates, offers, discounts, competitions, and other relevant information.

Newsletter subscription is voluntary. Where consent is required by applicable law, we will obtain your consent through an appropriate affirmative action, such as selecting an unticked checkbox or completing a clearly presented subscription form.

Accepting these Terms, creating an account, purchasing credits, or subscribing to a paid plan does not, by itself, constitute consent to receive marketing emails.

Use of Contact Information

Where you subscribe to our newsletter, we may use your email address and relevant subscription preferences to send the marketing communications you have agreed to receive, administer your subscription, and maintain records of consent and withdrawal.

We will process personal information for these purposes in accordance with our Privacy Policy and applicable data protection and electronic-marketing laws.

Promotional Offers

We may offer newsletter subscribers discounts, bonus credits, limited-time promotions, or other promotional benefits. Each promotion may be subject to separate terms and conditions, including eligibility, redemption periods, availability, usage restrictions, and other applicable requirements.

Promotional descriptions will be presented in accordance with applicable consumer protection and advertising laws. Unless expressly stated in the applicable offer terms, subscribing to the newsletter does not guarantee access to any particular promotion.

Withdrawal of Consent and Unsubscribe

You may withdraw your consent to receive marketing emails or unsubscribe at any time using the unsubscribe link provided in the relevant email or another available method.

We will process unsubscribe requests within the timeframe required by applicable law. We will not require you to pay a fee, provide a reason, or log in to your account where doing so would unlawfully obstruct your unsubscribe request.

After you unsubscribe, we will stop sending marketing emails where required by applicable law and update our marketing records accordingly. We may retain limited information necessary to record your withdrawal, maintain a suppression list, demonstrate compliance, or meet other lawful obligations.

Unsubscribing from marketing emails does not automatically delete your Bored2AI account, cancel a paid subscription, reverse a purchase, or stop essential service-related communications that we are lawfully entitled or required to send.

Existing Users and Consent Records

We will not treat account registration or the mere provision of an email address as automatic consent to receive marketing emails. Where required, we will rely on recorded consent or another lawful basis or applicable exception before sending marketing communications.

We may maintain records of newsletter subscriptions, including the consent wording, date and time, subscription source, subscription status, and any subsequent withdrawal, as reasonably necessary to demonstrate compliance with applicable law.

Marketing Preferences and Data Rights

You may exercise applicable rights relating to your personal information, including rights to access, correct, delete, or object to certain processing, subject to the conditions and exceptions under applicable law.

Requests relating to account deletion or other personal-data rights will be handled separately from newsletter unsubscribes and in accordance with our Privacy Policy and applicable law.

Email Communications

Marketing emails will identify the sender and include an appropriate means of contacting us and an unsubscribe mechanism. We will provide any additional sender information, postal address, disclosures, or other information required by the laws applicable to the relevant communication.

We may use third-party email service providers to deliver and administer communications on our behalf, subject to applicable data protection requirements.

11. Suspension or Termination

We may suspend or terminate your account if:

• You violate these Terms.
• You engage in prohibited content or activities described in the Acceptable Use or MENA Region Specific Requirements sections.
• You misuse Community Content or the remix functionality, or use them in a manner that violates these Terms or applicable law.
• Your account creates security risks.
• Your account is used for fraud, abuse, or unlawful activities.
• We are required to do so by law or by a competent regulatory or law-enforcement authority.

For serious violations, including CSAM, non-consensual intimate imagery, violent extremism, or other serious prohibited activities, we may immediately and permanently terminate the relevant account without prior notice, subject to applicable law.

You may close your account at any time by contacting us.

Closing your account does not necessarily result in the immediate deletion of all previously shared content, remixes, or information retained for legitimate operational, security, legal, or compliance purposes. Any retention or continued availability will remain subject to applicable law, our Privacy Policy, and any rights that apply to the relevant content.

Unsubscribing from marketing communications does not require you to close your account and will not, by itself, affect your access to Bored2AI or any existing paid subscription.

12. Intellectual Property

Bored2AI owns all rights to our website, software, branding, logos, and platform, except for third-party materials and rights expressly belonging to others.

These Terms do not grant you ownership of our technology or trademarks.

Except for the limited licences expressly granted under these Terms, no rights in Bored2AI's intellectual property are transferred to you.

Nothing in this section alters the ownership of Your Content as described in Section 8 or grants you rights in another user's content beyond the permissions expressly provided under these Terms.

13. Disclaimer

Bored2AI is provided "as is" and "as available", to the maximum extent permitted by applicable law.

We do not guarantee that:

• Our services will always be available.
• AI-generated content will be accurate or original.
• Our services will always be error-free or uninterrupted.
• Any content generated through our services will be lawful or suitable for use in every jurisdiction.
• Community Content or remixes will remain available or meet your expectations.
• Content shared by other users will be accurate, lawful, authorised, or suitable for your intended use.
• Any particular newsletter, promotional offer, discount, or bonus will remain available unless expressly provided in the applicable offer terms.

You use our services at your own risk, subject to any rights that cannot be excluded under applicable law.

14. Limitation of Liability

To the maximum extent allowed by law, Bored2AI is not liable for indirect, incidental, or consequential damages, including lost profits, lost data, or business interruption.

Our total liability relating to your use of the service will not exceed the amount you paid us during the previous six months, or USD $100, whichever is lower, to the extent permitted by applicable law.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

15. Governing Law

These Terms are governed by the laws applicable to the company operating Bored2AI.

Any disputes will be resolved through the appropriate courts or dispute resolution process in the jurisdiction where Bored2AI is registered, subject to any mandatory rights or requirements under applicable law.

16. Changes to These Terms

We may update these Terms from time to time.

The latest version will always be available on our website.

Where appropriate, we will notify users of material changes before or when they take effect.

Continued use of Bored2AI after changes become effective means you accept the revised Terms, subject to applicable law.
